Legal building blocks#
Part of the LDT Governance and Trust Framework — instantiates the iSHARE Data Space Template pillar Legal Building Blocks (© iSHARE Foundation, see Legal notices).
Purpose#
Two blocks, deliberately non-exhaustive. Regulatory compliance works from legal triggers — facts or events in a data space that mean a particular legal regime must be applied — and turns them into participant actions or governance-authority policies. Contractual framework gives a functional overview of the contracts a data space needs, grouped by object: institutional agreements, data-sharing agreements and service agreements, with the horizontal issues common to all sectors (fairness in data contracts, above all).
Neither block promises complete templates: requirements vary by sector and depend on business, governance and technical choices made elsewhere in this scheme.
LDT instantiation — where we stand#
The LDT's legal position is unusual in three ways, and each has to be answered explicitly rather than by reference to a generic rulebook:
- Public authorities as core participants. Cartagena and Almelo are municipalities, so open-data duties, the Data Governance Act and national administrative law bear on what they may share and under which conditions.
- A non-EU participant. Aruba Airport (FHC Corp) puts an international-transfer question at the centre of the scheme, not at its margin — see Regulatory compliance.
- Citizen and community data. The Aadorp PED and the Cartagena LEZ involve residents, which brings the GDPR and the Commons controls model into the contractual chain.
Contracts reuse iSHARE model agreements wherever they exist; the pilot's founding agreements (LDT4SSC Pilot Grant Agreement, EUTwinLink Consortium Agreement) sit above this scheme and are not restated by it.
